SAC Sportscars AG

1.Parties

The lessor is SAC Sportscars AG (hereinafter referred to as the “Lessor” or “SAC”). The lessee is the respective natural or legal person listed in the rental agreement who rents a vehicle from SAC (hereinafter referred to as the “Lessee”). The vehicles rented by SAC are generally exclusive sports cars from the luxury segment (hereinafter referred to as the “rental vehicles”), which is why the Lessee must comply with special requirements.

2.Lessee

The prerequisites for renting are a minimum age of 18 years and a Swiss category B driver’s license.

The Lessee may only transfer the usage rights from the rental agreement to another person with the Lessor’s consent. This additional driver must be specified at the time of contract signing.

3. rental price, deposit and payment methods

The agreed rental price and any agreed deposit must be paid in full before the start of the rental period. We reserve the right to make additional claims for use of the rental vehicle that goes beyond the agreement made (e.g. longer rental period).

SAC is entitled to offset the deposit against all claims against the tenant arising from or in connection with the rental agreement. A deposit may be required for international driving licenses. The amount of the deposit varies depending on the vehicle model and is refunded in full when the vehicle is returned in perfect condition.

Payment can be made by bank transfer, whereby SAC must receive the amount before the rental period begins. Alternatively, online payment by credit card is possible, with a surcharge of 3% on the rental price. Payment can also be made on-site in cash or via EC card.

4. Privacy policy

The SAC processes personal data in accordance with the applicable data protection regulations. This includes, in particular, contact details, payment information and rental details that are required for the fulfillment of the contract in accordance with Art. 6 para. 1 lit. b GDPR are processed.

Personal data will only be disclosed if it is necessary for contract fulfillment, required by law, or if the Lessee has given explicit consent.

The Lessee has the right to access, correct, delete, or object to the processing of their data. Requests can be sent to info@sac-sportscars.ch.

5.Bookings / cancellations

Bookings may be canceled by the Lessee up to 48 hours before the rental period begins. In the case of later cancellations by the Lessee, the full rental price remains due.

SAC reserves the right to cancel bookings due to bad weather or safety reasons without further explanation and without providing the Rental Vehicle. In such cases, the Lessee is not entitled to compensation.

6. Driving abroad

The Rental Vehicle may only be driven in Switzerland. Any exceptions must be approved in writing or by email by SAC in advance.

If driving abroad is permitted, all applicable foreign traffic laws—including those equivalent to the Swiss Road Traffic Act (SVG) and its regulations—must be complied with. The Lessee bears full liability for fines, legal proceedings, and any costs arising from non-compliance with such laws.

7. Use of the rental vehicle

The Lessee and any additional drivers must comply with the Swiss Road Traffic Act (SVG) at all times. The Lessee is solely responsible for all fines, legal proceedings, and other costs arising from violations of traffic laws, even if they were caused by an additional driver.

SAC, as the registered owner of the Rental Vehicle, is legally required to provide Lessee data to authorities upon official request. SAC may also submit vehicle usage records (including airbag control unit and infotainment system data) to authorities. A CHF 100.00 processing fee will be charged for administrative costs. SAC reserves the right to claim further damages.

The Lessee is responsible for all direct costs related to vehicle use, including fuel, tolls, and parking fees.

The Rental Vehicle may not be used for racing events or as a sports vehicle.

Electronic stability programs (ESP) or other control systems must not be deactivated at any time.

Smoking, eating, drinking, and carrying animals in the vehicle are strictly prohibited. Parking in underground garages or tight spaces is also not allowed.

8. Accidents & damage

The Lessee must immediately report any accidents or damages to SAC. In the event of accidents of any kind, the Lessee must call the police.

The Lessee is obliged to immediately report the revocation of their driver’s license as well as any circumstances that restrict their driving privileges, along with the temporary seizure or confiscation of the Rental Vehicle by SAC. The Lessee hereby authorizes SAC to access police and/or official records in the event of a damage claim.

Damage to the rental vehicle caused by engine over-revving, clutch overheating due to excessive slipping, aggressive starts, excessive tire wear, or any form of improper manipulation is fully borne by the Lessee. Such damages can be easily detected using diagnostic equipment.

9. Exclusions of liability

SAC and its agents disclaim all liability for contractual and non-contractual personal and/or property damages to the extent legally permissible and not covered by insurance. This includes liability for indirect damages, loss of profit, consequential damages, delays, vehicle unavailability, and missed business opportunities.

10.Insurance

Liability, comprehensive, or partial comprehensive insurance is included in the rental price. The deductible amounts to CHF 3,000.00 and CHF 5,000.00 for new drivers. Damages up to these deductibles are always borne by the Lessee.

Damages to the rental vehicle, rims and tires, engine and transmission, as well as mechanical and electronic damages resulting from improper driving (e.g., deactivating ESP) are not covered by insurance. The Lessee is fully liable for these damages, regardless of fault. The Lessee is also fully liable for accidents or damages caused by gross negligence or intentional misconduct.

The consumption of alcohol and drugs before or during the rental period is prohibited. Damages resulting from driving under the influence of alcohol or drug consumption are not covered by insurance and must be fully borne by the Lessee.

11.Vehicle pickup & return

The pickup and return of the rental vehicle take place at the SAC business location at Industriestrasse 168 in 8957 Spreitenbach. Upon both pickup and return, a condition report will be completed, and any damages will be recorded in writing. The rental vehicle is provided with a full tank and must be refueled with Bleifrei 98 or V-Power before being returned. The fuel receipt must be presented upon return. SAC reserves the right to report any damages up to 7 business days after the vehicle is returned.

12. Severability clause

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid provision shall be replaced with a valid one that best reflects the original intent.

13.Contractual penalty

If the Lessee violates any provision of the rental agreement or these General Terms and Conditions, they are obliged to pay a contractual penalty of CHF 1,000.00. The assertion of further claims for damages and any other claims remains expressly reserved.

14.Applicable law and place of jurisdiction

This contract is governed exclusively by Swiss law, excluding international private law. The exclusive place of jurisdiction is at the Lessor’s registered office in Zurich. However, the Lessor is entitled to file a lawsuit at the Lessee’s place of residence if desired.
